Scam to register Asian domain names

For several years, Asian companies have been pressuring firms to register identical domain names in Asian Top-Level-Domains (TLDs). It is a kind of scam called “Slamming”, and is an illegal practice to mislead firms in order to sell them unsolicited services.

Unknown third party, pressure, threats, high prices…

The slamming scam always begins with an email, written in English and adressed to the CEO of the targeted company. The hustler tries to contact the manager who is often ignorant of the rules related to domain names.

They present themselves as accredited Asian registrars, mainly in China. This unknown third party notifies the firm that one of their clients wants to register domain names containing the trademark of the tartget of the scam.

The eager Asian "registrar" realized that the targeted firm owns the rights to the domain names in question. For “ethical” reasons, the Asian provider kindly offers to register the domain in the name of the target instead of for their “client”. The prices are often prohibitive. The greedy scammer threatens to proceed with the initial domain registration request if the rights holder does not purchase the domain names within seven to fifteen days.

How do you react when faced with slamming?

When you receive the email, contact your usual domain name registrar. They will confirm the action as being a scam by the Asian registrar.

Several companies take advantage of these attacks to draft an efficient naming strategy. In fact, it is useless to register domain names in unpopular TLDs (see our ranking) such as .ORG.CN.

If your firm has interests in the Asian region then registrations in .ASIA and in the few local Country-Code-Top-Level-Domains (ccTLDs) were you are located (ex: .HK HongKong, .IN India, .JP Japan, .KR Korea, .SG Singapore, .TW Taiwan…) are more appropriate.

  • Dear Manager,

(If you are not the person who is in charge of this, please forward this to your CEO,Thanks)

We are a organization specializing in trademark consulting and domain name registration services in China. We just received an application sent from "HaiTon Importing Co., Ltd" on 27/07/2014, requesting for applying the "wheelsofitaly" as the Internet Brand and some Chinese domains such as .cn/.com.cn/.hk/.asia ect... for their business running. Though our preliminary review and verification, we found that this keyword is currently being used by your company and is applied as your domain name. In order to avoid any potential risks in terms of trademark dispute and impact on your market businesses in China and Asia in future, we need to confirm with you whether "HaiTon Importing Co., Ltd" is your own subsidiary or partner.

Will your businesses in China and Asia be impacted potentially if they apply for this trademark? And will you agree this company to apply for this trademark? Please contact us immediately within 10 working days, otherwise, you will be deemed as waived by default.

Please contact us in time in order that we can handle this issue better.

  • Dear Maria,

Thanks for your reply. What Candy Industries Ltd is eager to apply for registering are the following available domain names.
    [YOUR COMPANY].cn
    [YOUR COMPANY].asia
    [YOUR COMPANY].hk
    [YOUR COMPANY].com.hk
    [YOUR COMPANY].tw
    [YOUR COMPANY].jp

If you did not consign Candy Industries Ltd to register them, according to my work experience, there may be 2 possibilities.
    1. That company is a domain investor, they want to register these names before you and sell them back to you to gain profits;
    2. It may be a commercial method, that company is consigned by your competitor to register these domains and confuse your clients.

Because domain takes open registration, this is inter.ional domain registration principle, they have the right to register these available domains. As a domain name registrar, we have no right to reject their application. So required by our government to inform your company to protect your interest.

As the owner of "[YOUR COMPANY].com",you will get the priority to register these domains. If you think they are important and intend to register these domains,we can send you the application form, registration price and procedures to help you complete the registration within dispute period, this is the only way to prevent domain name from being grabbed. But if you don't think their application will do harm to your profits, you can give up.

Please give me your decision ASAP so that we can conduct the next step work.

  • Dear Sir/Madam,

Thanks for your confirmation. As soon as receiving the application of "CrlTeny Company"/"CanLduny Company", we checked and found "[YOUR COMPANY]" is your company's using name and brand. We are concerned that your brand name might be affected negatively by their applications, this is why we informed you. following Network Brand and domain names are applied by "CrlTeny Company"/"CanLduny Company":
    Net Brand: [YOUR COMPANY]
    Domain Names:
    "[YOUR COMPANY].asia
    [YOUR COMPANY].cn
    [YOUR COMPANY].cn.com
    [YOUR COMPANY].co.in
    [YOUR COMPANY].com.cn
    [YOUR COMPANY].com.tw
    [YOUR COMPANY].in
    [YOUR COMPANY].net.cn
    [YOUR COMPANY].org.cn
    [YOUR COMPANY].tw
    [YOUR COMPANY].中国
    [YOUR COMPANY].com.hk
    [YOUR COMPANY].hk"
You know that the domain names registration is open in the world, "CrlTeny Company"/"CanLduny Company" also has the right to apply for the available domain names. you only have the preferential rights to register them.
We also are not very clear about why the company wants to register these domain names, but according to our work experience, either they just invest these domain names.
Just like a company named Beijing national network information LLC registered google.cn & google.com.cn in 2005, and then they made lots of return from these two domain names. (Google Company failed to make a arbitration and paid 1 million USD dollars to redeem the two domain names.) Or they are just your trade, and confuse your clients to make profit.

At present, we haven't passed their application, we need your opinion. If your company consider these names of importance to your company's business or interest, I suggest that your company register these names first so as to avoid confusion or speculation. Of course, If you don't want to protect your intellectual property rights, then my suggestion is your company give up these names so that we can finish registering for them as per our duty. Please give me your company's decision as soon as possible in order to handle this issue better.
    Have a nice day.

How are you! The reason why I am sending you this email is because we received an application from "SYT Industry Ltd" today who wants to register the brand name:"keepalert" and some relevant domains under "keepalert" in different areas.
Due to the applicant's name "SYT Industry Ltd" is quite different from "[YOUR COMPANY]", so we checked in system and found "[YOUR COMPANY]" is your using name. In accordance with domain registration principle, we are obliged to inform you this case. Please confirm whether "SYT Industry Ltd" was authorized by you. If not, please contact me within 7 workdays for letting us handle this case properly. Out of the period, we would regard this application was authorized by you and accept their application legally. We are Centen Ltd based in Chinese office, our company has submitted the "[YOUR COMPANY]" as CN domain name and Internet Keyword, we are waiting for Ms. abby's approval. We hope your company will not object our application, because this name is very important for our products in Chinese market. We don't want your company to use this name in China, we believe our company will become the legal owner of this name in China. Even though Ms. abby advises us to change another name, we will persist in this name and permanent registration of this name.

  • Dear [YOUR NAME]:

    Thanks for email.
Based on your company having no relationship with them, we have suggested they should choose another name to avoid this conflict but they insist on this name as CN/Asia domain names (.asia/.cn/.com.cn) and internet keyword on the internet. In our opinion, maybe they do the similar business as your company and register it to promote his company. You must know Domain name takes open registration, this is international domain name registration principle. Any companies or individuals have rights to register any domain name and internet keyword which are unregistered. Because your company haven't registered this name as CN/ASIA domains and internet keyword on the internet, anyone can obtain them by registration. As a domain name registrar, we have no right to dispute their application. However, in order to avoid this conflict, as the owner of the name or trademark, your company will get the priority to make this registration in our audit period. If you think these domain names are useful for your company application form and the price list to you and help you register these CN/ASIA domain names (.asia/.cn/.com.cn/) and internet keyword within dispute period.

    Kind regards.

    Jim/Abby Wang

    Dear Sir/Madam,

    Thank you for your reply!
According to the principle of domain names registration, any individual or company has the legal right to register those available domain names. While your company is the intellectual property owner of"ginkgospace" , so you have the preferential right to do so, that's why we informed you. If you think the registration by the other company would affect your benefits, I suggest you to use your preferential right to register and protect those domain names. That's the best way to protect your intellectual property, pls confirm. If you agree with the suggestion, we will send you a dispute application form to fill out. And dispute the application of that company.Look forward to your reply.
